Competitips™ Contributor Program Terms

These Competitips (“Competitips”) Contributor Program (“Contributor Program”) terms and conditions (these "Contributor Terms") supplement and form an integral part of the then current Competitips.com Terms of Use available at competitips.com/page/terms-of-use (the "TOU"), and capitalized terms not defined herein shall have the meanings given to them in the TOU. To the extent of any conflict or inconsistency between these Contributor Terms and the TOU, the TOU shall prevail, except as expressly stated otherwise in these Contributor Terms. Digital Advisors reserves the right to change these Contributor Terms at any time by posting the change(s) here. Your continued participation as a Contributor to Competitips after such date shall constitute your agreement to such changes. In such cases, we will also update the "Last Updated" date set forth above. Please check this regularly for any changes.

Capitalized terms used but not otherwise defined herein shall have the meaning ascribed to such terms in the TOU.

General Terms Regarding Article submissions:

For the avoidance of doubt, an article (“Article”) or video (“Video”) you submit is a User Submission under the TOU, and (except as further described below in respect of Exclusive Articles or Videos) is therefore subject to the User Submission license granted to Competitips under the TOU including, without limitation, under Section 8 of the TOU (the "User Submission License") as well as the other submitter requirements and obligations with respect to User Submissions.

We may, in our sole discretion, make Articles or Videos freely available on our site(s), any social media site, our affiliate of partner’s sites or social media sites, place Articles or Videos behind any “paywall” and require users to pay to access the Articles or Videos, embargo Articles or Videos for paying subscribers, or any combination of the above.

We intend to take reasonable commercial measures to prevent Articles or Videos from being republished by other unauthorized websites or via other technologies; however, we are not responsible or liable for any actions of third parties, including the publication of Exclusive Articles or Videos without our consent.

We intend to take certain steps, now or in the future, to check whether Articles or Videos are free from plagiarism. Proper attribution of content taken verbatim from other sources requires the use of quotation marks and attribution links or footnotes. Plagiarism can also include the submission or posting of content that is repurposed from other sources and presented without reference to the content's creator. This includes, but is not limited to, content that is paraphrased from another source or could otherwise be deemed by a reasonable person to be a derivative work. We reserve the right to determine if Articles or Videos contain plagiarism and may, at its discretion, remove plagiarized content and refuse any further submissions from you and, if applicable, de-list you from being a Featured Contributor.

We hereby disclaim any and all liability to you as a Contributor, regardless of the form of action, whether in tort, intellectual property law, strict liability or any other cause of action or theory of law.

We may terminate, suspend or modify the Contributor Program and/or these Contributor Terms at any time and without notice or obligation to you. You may terminate your participation in the Contributor Program by not submitting any additional Articles or Videos. Termination of the Contributor Program, or of your participation in the Contributor Program, shall not terminate any license rights granted to Competitips for Articles or Videos submitted prior to such termination.

For the avoidance of doubt, these Contributor Terms shall also apply to third-party content acquired by us through an agreement with the author or producer to monitor his/her independent content feed and repost his/her content at our discretion.

Article or Video Exclusivity:

By indicating that an article or video is only being submitted for publication on, by or through Competitips (herein referred to as "Exclusive Content”) when you submit an Article or Video, you agree that Competitips will be your exclusive publisher for that Exclusive Content, for both online (such as the Site, including without limitation, our Social Media Platforms, and also our partner/affiliate platforms) and offline media, in each case as ee may determine in our sole discretion. Accordingly:

The User Submission License for said Exclusive Article shall be exclusive (instead of non-exclusive) to Competitips.

You represent and warrant that: (i) you have not published (or otherwise made available) the Exclusive Content, and will not publish it (or otherwise make it available) on any online or offline media, and (ii) you have not granted, and will not grant, any right or license to any third party that conflicts or is inconsistent with the license you grant us.

Notwithstanding the foregoing, you may publish a headline, short teaser, and/or brief summary/snippet of the Exclusive Content (up to 250 words but no more than 1/3 of the total exclusive Article or 15 seconds of an exclusive video) on any online media, and link to the full Exclusive Content on the Competitips’ Site (or its approved partner/affiliates) page, site or link at which it appears.

References in these Contributor Terms to an "Exclusive Content" shall also be deemed to include and apply to any article, video (or similar Content) that is substantially similar to the Exclusive Content, or that is a derivative work of the Exclusive Content. For example, you may not publish a translated version of Exclusive Content on any online or offline media.

While you agree and acknowledge that you are not being monetarily compensated by Competitips for any submission, you agree and acknowledge the receipt and sufficiency of consideration by being a Contributor, whether in the way of publicity rights, being able to claim that you are a Contributor to Competitips or otherwise, for the license to content granted to Competitips hereunder and the under the TOU. If you agree to submit Exclusive Content, we will be more likely to amplify the reach of the content by taking various steps, at Competitips’ sole discretion, which may include but not be limited to: marking the content as Exclusive to Competitips or other similar designation, listing frequent or prominent contributors to the Featured Contributor section or, to the extent we deems it to be beneficial, amplify any content through paid advertising.
